1. Agreement
These Terms of Service govern access to and use of PopClk (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
2. The Service
PopClk provides campaign tracking, reporting, link management, and related tooling for affiliate marketing teams. Features may change over time as the product evolves.
3. Accounts and organizations
You are responsible for maintaining accurate account information, securing credentials, and all activity under your organization workspace. Organization owners and admins control member access, billing, and integrations.
4. Acceptable use
You may not misuse the Service, attempt unauthorized access, interfere with platform operation, abuse rate limits, or use the Service in violation of applicable law, ad network policies, or affiliate network terms.
5. Customer data
You retain ownership of data you submit to the Service, including campaign metadata, tracking links, reporting data, and integration credentials. You grant us the rights needed to host, process, and display that data to provide the Service.
6. Billing
Paid plans, usage limits, and overage terms are described on the billing page and in plan documentation. Fees are billed according to the subscription selected for your organization unless otherwise agreed in writing.
7. Third-party services
The Service integrates with third-party platforms such as ad networks, affiliate networks, analytics providers, and payment processors. We are not responsible for third-party outages, policy changes, or data accuracy outside our control.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PopClk WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM USE OF THE SERVICE.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service, customers, or our legal obligations.
